Fontana is a co-permittee under the Santa Ana Regional Water Quality Control Board's MS4 Permit (NPDES permit) which regulates discharges from the city's storm drain network into the Santa Ana River watershed. FMC Title 15 (Stormwater Quality) prohibits discharging anything other than uncontaminated stormwater, household water (from lawn irrigation), and a limited list of exempt flows into gutters, storm drains, or channels. Common prohibited discharges are wash water from washing cars or equipment, sediment-laden runoff, paint rinse water, concrete slurry, landscape chemicals, and motor oil. Construction sites of one acre or more (and some smaller sites) must file a Notice of Intent under the statewide Construction General Permit, prepare a Stormwater Pollution Prevention Plan (SWPPP), and install Best Management Practices (BMPs) such as silt fences, stabilized construction entrances, and sediment traps. Priority development projects (new and redevelopment) must meet the MS4's Low Impact Development (LID) standards by capturing and infiltrating or treating the 85th-percentile storm. Fontana conducts industrial-facility inspections at the many logistics warehouses citywide to check for stormwater compliance. Illicit discharges can be reported to the Fontana Public Works stormwater hotline.
Fontana may issue administrative citations of $100, $200, and $500 per violation and seek injunctive relief. Federal Clean Water Act penalties can reach $64,618 per day per violation under 33 USC 1319.
