Kyle, TX Environmental Rules: Erosion Control (2026)

The erosion and sedimentation control plan must show proposed fill or other elevating techniques, levees, channel modifications and detention facilities, plus existing and proposed topography surveyed at vertical intervals no greater than one foot and tied to a USGS or Coastal and Geodetic Survey benchmark (§ 32-45(3)a, b). It must detail the location, size and character of every temporary and permanent erosion and sediment control that will be built and maintained throughout construction, and the city engineer may require mulch tubes instead of wire silt fencing in areas found to be high-runoff or environmentally sensitive, though mulch tubes are not mandated citywide (§ 32-45(3)c).

The plan must also identify contractor staging areas, vehicle access areas, and temporary and permanent spoils storage, along with a restoration plan to mitigate erosion in any area disturbed during construction (§ 32-45(3)d, e). Every temporary and permanent control must ultimately be designed to the Austin Drainage Criteria Manual, adopted by reference with the City of Kyle substituted for the City of Austin's departments and specific paragraphs excluded (§ 32-45(3)f, (5)f). This erosion control plan is only one part of the larger site development plan required for any lot zoned other than single- or two-family residential, or intended for a use other than single- or two-family residential occupancy (§ 32-42), and if conditions change after approval, the plan must be resubmitted and approved again by city staff before work continues (§ 32-50).
