Kyle, TX Environmental Rules: Stormwater Management (2026)

Article IX of Chapter 50, adopted by Ordinance 891 and substantially amended by Ordinance 942, regulates non-stormwater discharges to Kyle's municipal separate storm sewer system (MS4) to comply with the federal National Pollutant Discharge Elimination System permit process; § 50-400 states its purpose is protecting health, safety and welfare by controlling pollutants entering the MS4 within the city limits and ETJ to the maximum extent practicable. Section 50-402 applies the article to all developed and undeveloped land in the city limits, ETJ, or on city-owned property.

Section 50-406(a) bars any person from dumping, spilling, leaking, pumping, pouring, emitting, emptying, leaching, disposing or otherwise introducing pollutants or polluted water into the MS4 or its conveyances, and § 50-406(b) separately bars constructing, using or maintaining an illicit connection to the storm drain system, including undocumented connections made before the rule existed. The city administers the article through the city manager or a delegate under § 50-403 and enforces it under § 50-417 with a notice-of-violation process that can require monitoring, cease-and-desist of discharges, remediation, source-control best management practices and payment of a penalty; repeat violations documented twice in five years support additional penalties, and the city may issue emergency cease-and-desist orders, suspend MS4 access, or issue a construction stop-work order.

Section 50-418 sets the criminal penalty: a misdemeanor punishable by up to $2,000.00 per offense, with each day of a continuing violation a separate offense, plus a civil action to recover unpaid charges, interest, attorney fees and costs.
