Laguna Niguel, CA Environmental Rules: Erosion Control (2026)

The Community Development Department's Building Official enforces Laguna Niguel's erosion and sediment control rules under Sec. 8-1-835 through Sec. 8-1-837 of the grading and excavation code. Any grading site under an active permit must have desilting basins, check dams, riprap or comparable water-quality devices in place for the rainy season, defined as October 1 through April 30. During the dry season, May 1 through September 30, the same protective devices must be deployed within 48 hours whenever the forecast shows a 50 percent chance of rain.

Grading in excess of 200 cubic yards is barred outright between October 1 and April 30 on any permitted site unless the Building Official has approved or expressly waived an erosion control system for that project. Separately, Sec. 8-1-836 requires every project holding a grading permit to submit a full erosion control plan for the Building Official's approval by September 1 each year, ahead of the rainy season; the plan requirement can be waived for a single residential lot if the applicant has already installed, planted or constructed an approved system before October 1.

Once devices are installed, Sec. 8-1-837 requires the responsible civil engineer to inspect and repair them after every rainstorm, clear silt and debris from check berms and desilting basins, and pump the basins dry. Devices cannot be moved or modified without the Building Official's sign-off, and the contractor, permittee or owner remains responsible for maintaining them throughout the rainy season.
