Lakeville, MN Environmental Rules: Erosion Control (2026)

Lakeville City Code section 10-4-5 requires that development conform to natural topography and soil limitations to minimize erosion potential, and that erosion and sediment control measures be consistent with best management practices in the Minnesota Stormwater Manual (MPCA 2005), as amended, sufficient to retain sediment on site. Controls must meet the standards for the state's general NPDES construction stormwater permit (permit MN R100001) issued by the Minnesota Pollution Control Agency, with final site stabilization completed per that permit's requirements. Land must be developed in workable increments so adequate erosion and siltation controls can be maintained as construction progresses, exposing the smallest practical area for the shortest feasible period as specified in the development agreement.

Where topsoil is removed, it must be set aside and restored to a minimum depth of six inches, matching the pre-development soil quality. Natural vegetation must be protected wherever practical, and runoff must be diverted to a sedimentation basin before entering the natural drainage system, with on-site conveyance channels designed to withstand a 10-year storm without erosion. Section 10-4-5.H requires all temporary erosion and sediment controls to be installed on all down-gradient perimeters before land-disturbing activity begins and maintained until the site is stabilized, with permanent controls installed and operational per the approved design.

Section 10-4-5.I adds that disturbances over one acre on previously disturbed sites, such as tilled agricultural land, must seed unstabilized areas with temporary or permanent cover before commencing land disturbance, per NPDES general construction permit part IV.B.5 timeframes.
