Hutto, TX Environmental Rules: Vehicle Idling Restrictions (2026)

Hutto Code of Ordinances § 22.06.002 limits the idling article to the warm-weather months, April 1 through October 31 of each year. Within that window, § 22.06.003 makes it unlawful to cause, suffer, allow, or permit a motor vehicle's primary propulsion engine to idle more than five consecutive minutes when the vehicle is not in motion. Section 22.06.004 lists eleven affirmative defenses a defendant must prove by a preponderance of the evidence under § 22.06.005: the vehicle's gross vehicle weight rating is 14,000 pounds or less; it's stalled by traffic conditions outside the operator's control; it belongs to the military, national guard, or an emergency/law-enforcement fleet; the engine powers non-propulsion mechanical equipment; it's running for maintenance, diagnostics, or to defrost a windshield; or it supplies heating or air conditioning for commercial passenger transportation, school buses, or passenger transit operations, in which case idling up to 30 minutes is allowed.

A construction or roadway-maintenance vehicle providing climate control for an employee performing an essential job function is also excused, as is airport ground support equipment. Section 22.06.006 clarifies the article doesn't relieve anyone of separately complying with Texas Transportation Code section 545.404 governing unattended motor vehicles. The ordinance doesn't name a specific enforcing department, so citations follow the general municipal court process used for other traffic-code violations.
