Summary

In Sheboygan, Appendix E of the Municipal Code requires a post-construction runoff permit, a stormwater management plan and a maintenance agreement for sites that had five or more acres of land disturbance. Smaller sites over 1,000 square feet need a permit and must meet the peak discharge standard. The Director of Public Works administers and enforces the ordinance.

(a) Where not otherwise limited by law, this ordinance applies after final stabilization to a site of land disturbing construction activity meeting any of the criteria in this subsection, unless the site is otherwise exempt under subsection (b): 1. A post construction site that had five or more acres of land disturbing construction activity. ... 3. A post-construction site that had more than 1,000 square feet but less than one acre of land disturbing activity shall be required to obtain a permit under this ordinance, but shall only be required to comply with the performance standards contained in ... § 7(3)(b) regarding peak discharges unless otherwise required by the administering authority. ... 1. For new development, by design, reduce to the maximum extent practicable, the total suspended solids load by 80 percent, based on the average annual rainfall, as compared to no runoff management controls. ... At a minimum, the post-construction site shall detain the ten-year, 24-hour design storm released at the two-year, 24-hour predevelopment peak discharge rate.

Full Breakdown

Appendix E, the Post-Construction Stormwater Management Zoning Ordinance, was adopted under Wisconsin Statutes section 62.234 and names the Director of Public Works, or a designee, as the Administering Authority. It applies after final stabilization to a post-construction site that had five or more acres of land disturbance, to a post-development site that had one or more acres after March 10, 2003, and, under Section 4(1)(a)3, to a site with more than 1,000 square feet but less than one acre of disturbance, which needs a permit but only has to meet the peak discharge standard unless the authority requires more. Section 4(2) extends the ordinance to land in the City's extraterritorial zoning jurisdiction even when plat approval is not involved. Exempt sites include a redevelopment with no increase in exposed parking lots or roads, a site with less than ten percent connected imperviousness where all parking lots and rooftops total under one acre, agricultural and silviculture discharges, and underground utility construction.

The performance standards in Section 7 set numbers. For new development the plan must reduce the total suspended solids load by 80 percent to the maximum extent practicable; for redevelopment the figure is 40 percent. Peak runoff must be held at or below predevelopment rates for the two-year, 24-hour design storm, and the site must at a minimum detain the ten-year, 24-hour design storm released at the two-year predevelopment rate. The Administering Authority can require retention up to the 100-year storm because of downstream threats, and the grading plan must pass the 100-year storm around or through the development without harm to life or property. Residential developments must infiltrate runoff so that post-development infiltration volume is at least 90 percent of pre-development volume, using no more than one percent of the project site, or infiltrate 25 percent of the post-development runoff from the two-year, 24-hour design storm.

Under Section 8, no responsible party may undertake land disturbing construction activity without a post-construction runoff permit. The application carries the plan, a maintenance agreement and a non-refundable administration fee, and the authority answers within 30 business days of a complete application, or ten business days after added information arrives. Fees are set by Common Council resolution under Section 12. The text reflects the Municode edition current to its 2023 update.

Violations & Fines

Section 13 has the Administering Authority notify the responsible party by certified mail of non-complying work, post a stop work order, revoke the permit, or refer the matter to the city attorney. Any person who does not comply faces a forfeiture of not less than $50.00 and not more than $1,000.00 per offense plus costs of prosecution, and each day is a separate offense. Unpaid City repair costs go on the tax roll as a special charge against the property.

Frequently Asked Questions

Does a small lot in Sheboygan need a stormwater permit?
Section 4(1)(a)3 covers a post-construction site with more than 1,000 square feet but less than one acre of land disturbing activity. It must obtain a permit but only has to meet the Section 7(3)(b) peak discharge standard unless the Administering Authority requires more, and Section 8(2)(c) drops the maintenance agreement for those sites.
Who decides on a Sheboygan stormwater permit application?
The Director of Public Works, or a designee, is the Administering Authority under Section 1(3). Within 30 business days of a complete application the authority must say whether the application, plan and maintenance agreement are approved or disapproved, and a disapproval must detail the reasons in writing. Added information triggers a ten business day decision window.
Are there sites outside Sheboygan city limits covered?
Yes. Section 4(2) applies the ordinance to post construction sites within the City and also to all lands within the extraterritorial zoning jurisdiction of the City of Sheboygan, even if plat approval is not involved. State agency activities are excluded under Section 4(3), and Section 1(4) leaves stricter DNR requirements in force.
What infiltration is required for residential development?
Section 7(3)(c)1 asks residential developments to meet one of two tests: infiltrate enough runoff that post-development infiltration volume is at least 90 percent of pre-development volume, with no more than one percent of the project site required as effective infiltration area, or infiltrate 25 percent of the post-development runoff from the two-year, 24-hour design storm.
