Perth Amboy, NJ Fence Regulations: Fence Permit Requirements (2026)

Chapter 184 of the Perth Amboy City Code, the Uniform Construction Code chapter, lists flat Building Subcode fees in § 184-2. Item (2) in that list is "Fences over 6 feet high" at $75, and the list closes with a $75 minimum fee. The Office of Construction and Fire Prevention, headed by the Construction Official, administers the code under § 184-1. In a floodway, § 231-801.4 adds that foundations for fences greater than six feet in height must conform with the Uniform Construction Code.

The zoning chapter adds its own permit gate. Section 430-101 C(1) makes the Zoning Officer responsible for enforcement and says no building permit shall be issued unless the plans are accompanied by an approved zoning permit. Section 430-103 says no building or other structure shall be erected, moved, added to or structurally altered without a building permit issued by the administrative official designated by the governing body.

The fence standards are in § 430-60 F. Fences and walls shall not be located in any required sight triangle. A fence cannot exceed four (4) feet in height at any point within the front yard. Fences and hedges running parallel to side or rear yard lines can reach six (6) feet when located in the side or rear yard of a dwelling in a residential zone, to the rear of the rear building line. An open wire fence up to eight (8) feet is allowed within a public park, public playground or school premises, and fences in an industrial zone in side and rear yards to the rear of the principal building can be eight (8) feet. Every fence, wall and hedge must sit within the property lines and cannot encroach on a public right-of-way. The finished side faces outward, and the height is measured from the ground directly under the fence to its highest point. Fences on property bordering crosswalks that bisect two residential properties cannot exceed six (6) feet on the crosswalk side and must be set back at least two (2) feet. The maximum height does not apply within ten (10) feet of the periphery of a private wading or swimming pool.
