The film permit ordinance sits in Title 5, Division 3, Article 23 of the Laguna Niguel Municipal Code, adopted by Ordinance No. 90-11 on March 6, 1990. Section 5-3-337 requires anyone using city or special-district property or facilities for motion picture production, television production or still photography to first apply for and receive a film permit from the issuing agency, defined at Section 5-3-336 as the director of community development or a designee. Section 5-3-338 lists four exemptions from the article: charitable films by 501(c)(3) nonprofits and news media are exempt from permit fees; private, personal-use filming and on-the-spot news broadcasting are exempt from the article entirely; and subsection (b) exempts student filmmakers from permit fees when the applicant submits a letter on school letterhead, signed by a school administrator or instructor, stating the applicant is currently enrolled in a recognized United States educational institution and that the resulting film, videotape or photograph is not for commercial release.

The fee waiver does not excuse the applicant from the permit application itself, from posting a refundable cleanup and restoration surety under Section 5-3-339 if the issuing agency requires one, or from the $1,000,000 comprehensive general liability insurance naming the city as additional insured required by Section 5-3-340. The issuing agency may deny or revoke a permit under Section 5-3-342 for activity that interferes with normal use of the property or is contrary to public health, safety or welfare.
