Alhambra is one of the few San Gabriel Valley cities that still permits state-approved 'Safe and Sane' fireworks. They may be sold from 12 noon June 28 through 12 noon July 6 from licensed nonprofit stands. All other ('dangerous') fireworks are illegal under California's State Fireworks Law, and violators face misdemeanor fines.
Alhambra has its own Fire Department and regulates fireworks under Title 19 of the Alhambra Municipal Code, including Chapter 19.01 (Sale of Safe and Sane Fireworks) and Chapter 19.02 (Fire Code). Unlike most Los Angeles County cities, which ban all fireworks, Alhambra still allows 'Safe and Sane' fireworks — the only fireworks approved by the State Fire Marshal that do not meet the definition of 'dangerous fireworks' (California Health & Safety Code 12529 and 12505). The Alhambra Fire Department's Regulations for Fireworks Stands restate state law: no Safe and Sane fireworks may be sold at retail except from 12 o'clock noon on the 28th of June to 12 o'clock noon on the 6th day of July of each year (Health & Safety Code 12703), and no fireworks may be sold to anyone under 16. Stands must post the rules, keep two marked exits, two fire extinguishers, 'No Smoking' signage with a 25-foot smoking ban, and may not be located within 600 feet of another stand or 100 feet of a gas station. Items must bear the State Fire Marshal's Seal of Registration with protective fuse caps (Health & Safety Code 12704). Everything outside the Safe and Sane category — firecrackers, bottle rockets, sky rockets, Roman candles, aerial shells — is a 'dangerous firework' and illegal to use, possess, or sell anywhere in California without a State license or permit.
Possessing, selling, or using 'dangerous' fireworks violates California Health & Safety Code Part 2 (Fireworks). Under Section 12700, a person who violates the fireworks law is guilty of a misdemeanor punishable by a fine of not less than $500 or more than $1,000, or up to one year in county jail, or both. Possession of dangerous fireworks without a permit (Section 12677) carries escalating fines that rise with the gross weight possessed — from $500–$1,000 for under 25 pounds up to $10,000–$50,000 for the largest quantities.
