Commerce City, CO Fire Regulations: Fireworks (2026)

The city's fire code, adopted by Sec. 5-41001 as an amendment to the 2021 International Fire Code Section 5601.1.3, makes possessing, manufacturing, storing, handling or using fireworks unlawful within Commerce City except in six narrow circumstances. Storage and handling under Section 5604, manufacture and testing under Section 5605, and licensed public fireworks displays under Section 5608 remain lawful, as does display and use of 'permissible fireworks' under C.R.S. § 24-33.5-2001(11), Division 1.4G items such as sparklers, fountains and other novelties that comply with NFPA 1124 and federal consumer product and transportation rules.

Even permissible fireworks may only be used outdoors on three dates each year: July 3, July 4 and December 31, and only between 10:00 a.m. and 11:00 p.m. Anyone over sixteen may use them, and those under sixteen may only do so under direct adult supervision. Fireworks possessed, offered for sale, manufactured, stored or used unlawfully may be seized and removed at the violator's expense. Within any city park the rules are stricter still: Sec. 7-1008 bans possessing or discharging fireworks on park property entirely unless the city specifically authorizes the area in writing.

Enforcement of the fire code amendment falls to the South Adams County Fire Protection District or the Greater Brighton Fire Protection District, whichever covers the property, both of which hold the fire code official's inspection and citation authority. Because the fire district operates separately from the Commerce City Police Department, fireworks calls in most of the city go to the fire district rather than police dispatch.
