Unlike most California cities, Dublin permits state-approved "safe and sane" fireworks under Municipal Code Chapter 5.24. They may be sold only by qualifying Dublin nonprofits from noon June 28 to noon July 5, and used by residents on private property during that window. All "dangerous" fireworks are banned.
Dublin is one of the few Alameda County cities that does not ban all consumer fireworks. Dublin Municipal Code Chapter 5.24 expressly permits "safe and sane fireworks" as defined in California Health & Safety Code Section 12529, except as limited by the chapter (DMC 5.24.020.C). "Dangerous fireworks" under H&SC Section 12505 are prohibited, as is the manufacture of any fireworks in the city (DMC 5.24.020.A-B). Retail sale is limited to temporary stands operated by nonprofit 501(c)(3) organizations that have a permanent meeting place in Dublin, at least 20 Dublin resident members, and at least one year of operation in the city (DMC 5.24.060). The sales window runs from 12:00 p.m. June 28 to 12:00 p.m. July 5 each year, with no sales after 10:00 p.m. or before 8:00 a.m. (DMC 5.24.070.D). The city limits permits to one per 3,000 residents and holds a random drawing if applications exceed that cap (DMC 5.24.050). Per the city's Fireworks page, residents may use safe and sane fireworks on their own private property during the sales period, but not at city parks, schools, businesses, or multi-family complexes such as apartments or condominiums. The city maintains a zero-tolerance policy for illegal fireworks.
Violations of Chapter 5.24 are infractions punishable as provided in California Government Code Section 36900(b) (DMC 5.24.150). The city's Fireworks page states that those caught using illegal (dangerous) fireworks will be fined the maximum penalties allowed by state law and could face jail time. The Fire Chief may seize fireworks held in violation of the chapter at the owner's expense (DMC 5.24.130).
