All consumer fireworks—including 'Safe and Sane'—are illegal to possess, sell, use, or discharge anywhere in the City of Fairfield. The ban is enforced by Fairfield Police and Fire under Municipal Code Chapter 11 and California Health & Safety Code Sections 12500-12727. Only party poppers and snap caps are allowed.
Although the State of California allows local jurisdictions to permit 'Safe and Sane' fireworks, the Fairfield City Council has chosen a total ban. Per the Fairfield Police Department, the use, sale, and discharge of any pyrotechnic device classified as 'dangerous fireworks' or 'safe and sane fireworks' under California Health and Safety Code Section 12500 et seq. is prohibited within the city limits. The narrow exception is for novelty items: party poppers and snap caps. Aerial shells, mortars, bottle rockets, M-80s and similar 'dangerous fireworks' are felonies under state law (H&S 12677). Public fireworks displays require a state pyrotechnic operator license and a city permit from the Fire Marshal. Fairfield runs an anonymous 'See Something, Say Something' tip line in the weeks before July 4th. Spent shells, debris in driveways, and social-media video are commonly used as evidence; property owners can be cited even if the user was a guest.
Possession or discharge of consumer fireworks is an infraction or misdemeanor under California H&S 12700-12727 with fines up to $1,000 and/or up to one year in county jail. Fairfield also issues administrative citations through Code Enforcement, and a property owner who allows fireworks use on their property may be assessed civil penalties. Dangerous fireworks (50+ pounds) escalate to felony charges.
