(a)It shall be unlawful for any person to intentionally and knowingly own, possess, sell, offer for sale, ignite, or otherwise use fireworks within the city.(b)It shall be unlawful for any person to sell or offer for sale any fireworks in any unincorporated area within five thousand (5,000) [feet] of the city limits.(c)The provisions contained in subsections (a) and (b) above shall not apply to those fireworks enumerated in V.T.C.A., Insurance Code art. 5.43-4, § 4, or to sales of fireworks by and between fireworks wholesalers.(d)The term "firework," as used herein, means a small device designed primarily to produce visible effects by combustion, that complies with the construction and chemical composition requirements of 16 C.F.R. Part 1507 (1984), or the most recently adopted version of that rule, and the labeling requirements of the United States Consumer Product Safety Commission, and that is classified as a Class C explosive by the United States Department of Transportation.

Enforcement falls to the Grand Prairie Fire Marshal's office and police department, and the section carries no fireworks-specific fine, so any violation defaults to the Code's general penalty structure in Sec. 1-8.

Fireworks offenses fall under Code Sec. 1-8(c), which sets fire-safety violations at a fine of up to $2,000.00 per offense rather than the Code's ordinary $500.00 cap, because fire-safety violations are carved out for the higher tier. Each day a person continues to possess or sell banned fireworks is a separate offense under Sec. 1-8(b). Claiming a public display or a wholesale transaction is not a defense unless it fits the Insurance Code art. 5.43-4, section 4 exemption exactly.
