Perth Amboy, NJ Fire Regulations: Fireworks (2026)

Chapter 230 of the Perth Amboy City Code, first adopted by the Board of Commissioners on 8-10-27 as Ord. No. C-27, is a flat ban on fireworks inside the corporate limits of the City of Perth Amboy in Middlesex County, New Jersey. Section 230-1 says no person or persons, firm or corporation shall sell, use or possess what are commonly and commercially known as "fireworks," including everything designed and manufactured primarily for the production of pyrotechnic effects. The only carve-out in that section is railroad signaling torpedoes and similar devices.

Section 230-2 defines what counts. The list is marbles coated with any explosive mixture, fireworks containing picric acid or pirates, colored fire, skyrockets, aerial bombs, pistols, cannons, canes or other appliances using blank cartridges or using caps containing chlorate of potash mixture, bombardments or mandarins made of chlorate of potash mixture, cartridge exploders and torpedoes. Section 230-3 closes the licensing door: no permits or licenses of any kind are issued for the sale of fireworks at retail or use thereof within the City.

Enforcement sits with the Perth Amboy Police Department. Under § 230-4 the Police Department has the power to confiscate and destroy all fireworks prepared for retail sale or use in violation of the chapter, so a seizure does not wait on a court case.

Two exceptions are printed. Section 230-5 leaves the wholesale sale and storage of fireworks to be regulated under any existing ordinance, and § 230-6 says nothing in the chapter interferes with the use of fireworks in connection with any civic celebration under the sanction of municipal authorities of the City of Perth Amboy. Section 230-7 sets up a five-member Citizens Fireworks Committee, appointed by the Mayor to terms of five years, which advises on organizing, coordinating and funding Fourth of July activities. The Committee cannot expend or obligate public funds without the consent of the City Council. The stated purpose of the whole chapter is the preservation and protection of human lives, public and private property.
