Provo allows Class C (state-approved) fireworks on the dates and hours fixed by Utah Code 53-7-225, but bans discharge in the east foothills and most city parks because of wildfire hazard. Discharge outside the legal dates/times is a state infraction with a fine up to $1,000.
Utah Code 53-7-225 supersedes any local provision on when fireworks may be sold or discharged, so Provo cannot move the calendar. A person may discharge a division 1.4G (Class C) common state-approved explosive only between 11 a.m. and 11 p.m. from July 2-5 and July 22-25 (extended to midnight on July 4 and July 24), from 11 a.m. Dec. 31 to 1 a.m. Jan. 1, 11 a.m.-11 p.m. on Jan. 1, and from 11 a.m. on Chinese New Year's Eve to 1 a.m. the next day. What Provo CAN control is location: under Utah Code 15A-5-202.5(1)(b), a municipality may prohibit discharge in mountainous, brush-covered, or wildland-urban-interface areas with hazardous environmental conditions. Provo uses this authority to close its eastern foothills (Y Mountain area, east of Timpview Drive/north of Canyon Road) and to bar fireworks in all city parks except thirteen designated parks (Sertoma, Exchange, Fort Utah, Sunset View, Provost, Kiwanis, Franklin, Carterville, Lakeview, Maeser, Rotary, Riverview, Spring Creek). The city publishes an official Fireworks Discharge Restricted Area map through Provo City GIS.
Discharging a Class C explosive outside the legal dates/times in Subsection (3), or inside a prohibited hazardous area under 15A-5-202.5(1)(b), is an infraction punishable by a fine of up to $1,000 (Utah Code 53-7-225(4)). Selling or using unauthorized (illegal/aerial) fireworks is a class B misdemeanor under Utah Code 11-3-11.
