Summary
Cumberland County bans manufacturing, selling, possessing, storing or using pyrotechnic devices for anyone in the county, going further than state fireworks law. Adults 18 and over may possess only a short list of named novelty items: snakes, smoke devices, party poppers, sparklers and similar low-hazard sparkling items.
It shall be unlawful for any person in the county to manufacture, sell, possess, store or use any pyrotechnic device, as defined in section 9.5-141; except that any person residing in the county who is over the age of 18 years may purchase, possess, and use the following pyrotechnic devices: (1)Snake and glow worms... (4)Wire sparklers consisting of wire or stick coated with nonexplosive pyrotechnic mixture that produces a shower of sparks upon ignition. These items must not exceed 100 grams of mixture per item.

County Code Sec. 5-142 makes it unlawful for any person in the county to manufacture, sell, possess, store or use a pyrotechnic device as defined in Sec. 5-141, which sweeps in "any and all kinds of fireworks and explosives" used for exhibition or amusement. The only exception is for county residents over 18, who may purchase, possess and use five listed categories: snake/glow worm pellets, smoke devices, trick noisemakers under 16 milligrams of explosive mixture (party poppers, string poppers, snappers), wire sparklers under 100 grams of mixture, and other sparkling devices capped at 75 grams per tube or 200 grams for multiple tubes, none of which may detonate, spin, or propel through the air.
Sec. 5-143 bars any merchant from selling these devices to anyone under 18, checked the same way as alcohol sales, and Sec. 5-144 bars distributing them to a minor without parental permission and adult supervision. Sec. 5-145 further bans possessing or using any of the listed devices in a school, theatre, shopping mall, church, public building, or other place of public assembly, regardless of age. 25 grams of explosive mixture, per Sec. 5-141's exception clause.
Violations & Fines
Anyone violating the pyrotechnics article is guilty of a misdemeanor punishable by fine and/or imprisonment under North Carolina General Statute 14-4, per Sec. 9.5-146. Sec. 9.5-147 allows the county to additionally enforce the article under County Code Sections 6.2-43 and 6.2-44, its fire prevention and protection provisions, so a single incident can draw both a criminal charge and a fire-code enforcement action.
