The city does not issue that permit itself; it channels land-clearing burns through the state agency's process rather than creating a separate municipal permit.

Subsection (b) handles the other common category, recreational burning such as a backyard fire, requiring it to 'comply with F.S. § 590.11, and other controlling law,' again deferring the operative standard to state statute rather than setting an independent city rule. Enforcement runs through the fire code's general violation section, § 42-12(a), which makes it 'prohibited and unlawful for any person to violate any provision of this chapter,' including the open-burning article; § 42-12(b) lets the city manager direct the city attorney to pursue code enforcement, abatement, or any other available legal remedy, and § 42-12(c) authorizes an immediate building closure and utility termination for violations that pose an immediate life-safety risk.

The fire marshal, acting under §§ 42-2 and 42-3 of the same chapter, holds code enforcement authority to close and secure premises or disable utilities when needed to protect public safety.
