Woodbury follows Minnesota law for smoke alarms. Minn. Stat. 299F.362 requires a working smoke alarm in every dwelling unit, mounted per the State Fire Code. Woodbury's fire division urges residents to maintain smoke alarms, noting they play a vital role in reducing fire deaths and injuries, but the binding requirements come from Minnesota statute rather than a separate local ordinance. Minn. Stat. 299F.362 provides that every dwelling unit within a dwelling must be provided with a smoke alarm meeting the requirements of the State Fire Code, mounted according to the smoke-alarm location rules adopted under the statute. In a newly constructed dwelling, each smoke alarm must be attached to a centralized (hard-wired) power source. For rental units where the occupant is not the owner, the owner is responsible for maintaining the smoke alarms; the occupant must inform the owner of a non-functioning smoke alarm within 24 hours of discovering it. An occupant who willfully disables a smoke alarm or renders it non-functioning, resulting in damage or injury, is guilty of a misdemeanor. The statute also protects tenants - no insurer may deny a fire-loss claim solely because a person failed to comply with the smoke-alarm requirement. Separately, Minnesota requires carbon monoxide alarms within 10 feet of each room used for sleeping in dwellings (Minn. Stat. 299F.50-.51); Woodbury's fire-safety materials warn that CO is an odorless, colorless gas produced by malfunctioning or poorly vented fuel-burning equipment.
