Statewide, Idaho Code 39-2609(4) makes it unlawful to use fireworks in any area that constitutes a severe fire threat based on current-season vegetative conditions as determined by the county commission or fire authority. Burning or using fireworks during a Bonneville County burn ban is prohibited; using fireworks in a designated severe-fire-threat area is an infraction with a $100 fine (Idaho Code 39-2609). Idaho Falls Fire officials can order hazardous open burning extinguished and cite under City Code 7-10-3(L).
