Section 67-1 makes it unlawful to vend, sell, set up a cart or stand, or prepare food for sale on any highway, street, alley or sidewalk in Fitchburg without first obtaining a vending license. Applications go to the economic development director under § 67-3 and must specify the food, goods or services offered and a specific vending site, unless the operation is non-stationary, such as a summer ice cream truck, in which case no fixed site is required. Licenses come in three forms: an annual license running April 15 to April 14 the following year, a 30-day monthly license, and a fee-free special-event license that can cover multiple vendors at a community festival.

Fees themselves are set in the separate city fee schedule. Every vendor must carry commercial general liability insurance with a $1,000,000 aggregate limit naming the city as an additional insured, with 30 days' notice required before cancellation. Section 67-4 restricts where a vending site can sit: no closer than ten feet to a fire hydrant, five feet to a standpipe or bus shelter, or ten feet to a curb cut or marked crosswalk, with six feet of clear pedestrian walkway maintained at all times; vending is also barred on any street directly adjacent to or across from school property as defined in Wis. 001(3r). in residentially zoned districts, and lets police remove noncompliant equipment on the spot.
