Food trucks operating in Newport Beach must obtain a city mobile food facility permit in addition to an Orange County Health Care Agency health permit. Operations are restricted by location, with prohibitions near the harbor, residential zones, and within 200 feet of restaurants during business hours. A valid Newport Beach business license and California seller's permit are required.
Newport Beach regulates mobile food vendors under NBMC Chapter 5.08 and Chapter 10.50. Food trucks must obtain a Newport Beach business license and a mobile food facility permit from the city. Operators must also hold a valid Mobile Food Facility Permit from the Orange County Health Care Agency (OCHCA) and a California seller's permit from the Board of Equalization. Food trucks are prohibited from operating in residential zones, on the Balboa Peninsula during peak summer months without specific authorization, and within 200 feet of an established restaurant during its hours of operation unless the restaurant owner provides written consent. Operations are limited to specific commercial and industrial zones as designated by the city. Vending near the harbor, public beaches, and city parks requires separate special event permits. Food trucks must not operate from any single location for more than one hour and must move at least 500 feet before stopping again. Vehicles must be self-contained with no external generators, power cords, or connections to buildings. Proper waste management including gray water containment is required. All food trucks must display their health permit, business license, and operator information visibly. Hours of operation are generally restricted to between 7:00 AM and 10:00 PM in commercial areas.
Operating without required permits is a misdemeanor under the Newport Beach Municipal Code. First-time violations may receive a warning or citation with fines starting at $250. Operating in a prohibited zone or within the restricted distance of restaurants can result in citations ranging from $250 to $1,000. Repeat offenders may have their business license revoked. Health permit violations are enforced by OCHCA and can result in immediate closure.
