Berwyn, IL Food Trucks & Mobile Vendors: Sidewalk & Mobile Vending (2026)

Berwyn does not write a separate sidewalk food vending ordinance. Food sold from a cart, truck or stand that is not a fixed place of business on private property falls under the peddler rules of Chapter 860 of the Berwyn Code of Ordinances, and § 860.06 adds that all peddlers of food must comply with every applicable regulation of the code and other laws relating to food dealers. A food vendor therefore holds the peddler license under § 860.02, which carries a $75 annual fee under § 801.13(AAA), and also answers to the city's food service rules.

Operating rules in § 860.04 govern how a vendor works the street. Division (G) bars interference with vehicular or pedestrian traffic on the public right-of-way, which is the core sidewalk rule. Division (H) bars peddling by shouting or by using any sound device, including bells or amplifying systems. That reaches ice cream trucks with chimes. Division (E)(1) also confines commercial peddling to 9:00 a.m. through 5:00 p.m. on weekdays, with no Sunday or holiday sales.

Ice cream peddlers get their own license terms under § 860.07. The license covers April 1 to September 30 of the same year, requires the fee in § 801.13(AAA), and is limited to no more than five such licenses in any year. Every applicant is fingerprinted by the local Police Department at the applicant's own cost. All other Chapter 860 provisions still apply.

The zoning code separately allows retailers a temporary sidewalk sale under § 1244.05(B)(5): three consecutive days, three sales per retailer in a 12 month period, and five feet of sidewalk clearance. That rule covers a shop's merchandise, not a street food vendor.
