Chapter 8.26 governs both roaming and stationary sidewalk vendors in the City of La Habra. Under § 8.26.030(B), the application must list the vendor's name and address, driver's license or tax ID number, the vending receptacle's dimensions, whether food or merchandise is sold, and proof of an Orange County Health Care Agency permit if food is involved, plus a California seller's permit and liability insurance naming the city as additional insured. Section 8.26.040 lets the director issue a permit within 30 days if the activity will not interfere with traffic, pedestrians or police protection, is not a fire hazard, and the vendor has paid past fines; permits are non-transferable, expire December 31 regardless of issue date, and run for a one-year term under subsection (D).

The director may deny, suspend or revoke a permit for false statements, unreported changes, loss of the required county health certificate, or a disqualifying conviction, and a revoked vendor cannot reapply for one year. Section 8.26.050 layers on operating rules once permitted: receptacles cannot exceed three feet in height, width and length, cannot be motorized, must keep a four-foot clear path of travel, and vendors must comply with the noise standards in Chapter 9.32. Veterans are exempt from the license fee under § 8.26.030(F), except for alcohol sales. Appeals of a denial, suspension or revocation go to a hearing officer under § 8.26.080 within 21 calendar days.
