Section 5.40.030 lists the prohibited locations. Vending is barred on any public property that is not a sidewalk or pathway, including roadways, alleys and parking lots. It is barred in areas zoned exclusively residential, though roaming vendors who keep moving and stop only to complete a sale are exempted from that residential ban. It is barred citywide in the Downtown Corridor and in named commercial centers, including The Shops at Montebello, The Mart, The Plaza, Towne Square, Greenwood Center, Garmar Plaza, Mart of Montebello and Downtown Plaza.
Distance buffers apply around sensitive uses: 500 feet from the Civic Center, City Hall, any park, police station, fire station, the Quiet Cannon or the golf course, from schools during a six a.m. to six p.m. window, and from places of worship around scheduled events; 50 feet from playgrounds and other sidewalk vendors; and 10 feet from crosswalks, fire hydrants, bus benches, driveways and ATMs. Stationary vendors additionally may only set up on a sidewalk or pathway at least eight feet wide, and may not vend at a park where the city has an exclusive concession agreement.
