Mesa, AZ Garage & Yard Sales: Frequency, Duration & Permits (2026)

Mesa City Code § 8-6-2 defines a garage sale as "the occasional and/or temporary sale of used or second hand tangible personal property from a residential location," also covering yard sales, carport sales and estate sales. The definition warns that the activity becomes a commercial use outside this exemption "when the garage sale activity takes place on a continuous basis, and/or the activity includes the sale of first hand merchandise manufactured off-premises," pushing the property into normal business-license and zoning requirements instead. " A responsible party who exceeds either the 4-events-a-year cap or the 3-day duration cap is subject to the Chapter's standard civil enforcement track: a citation under § 8-6-8, a civil sanction of $250 to $1,500 for a first finding under § 8-6-9(A), rising to $350–$2,500 for a second finding and $500–$2,500 for a third finding within 36 months.

A resident cited on 3 separate dates within 36 months becomes a habitual offender under § 8-6-11, exposing them to a Class 1 misdemeanor charge carrying up to 6 months in jail or a $2,500 fine.
