Municipal Code Section 18.05.040 governs Temporary Use Permits for short-term uses such as Christmas tree lots, circuses and promotional sales, but subsection C carves out an exception for garage sales in residential zones so they need no permit at all, provided the seller follows every listed requirement. Requirement 1 limits a lot to no more than four garage sales per calendar year, and requirement 2 caps each sale at two consecutive calendar days. Requirement 3 restricts merchandise to used household goods belonging to the property owner or occupant, expressly prohibiting goods obtained for resale as a business, and further limits display to no more than five items of the same kind, type or model and no more than two residential appliances at a time.

Requirement 5 sets sale hours between 7 a.m. and 7 p.m., while requirement 6 allows canopies, tables, racks and other setup fixtures to be placed outside as early as 5 p.m. the day before the sale, with everything removed from public view by 9 p.m. on the final day. Requirement 7 bans selling food, beverages, alcohol, tobacco, controlled or illegal substances, commercial appliances and equipment, firearms, ammunition, explosives, animals or livestock, items with removed serial numbers, or stolen merchandise at any garage sale.
