Texas Property Code Β§ 209.00505 establishes requirements for architectural review committees in HOAs with at least 40 lots. If an architectural request is denied, the committee must provide written notice via certified mail, hand delivery, or electronic means that discusses in reasonable detail why the proposal was denied. The homeowner has the right to request a hearing before the HOA board within 30 days of the denial notice. At the hearing, the board and homeowner discuss the proposal, confirm facts, and attempt to resolve the rejection. The committee must process requests within a reasonable timeframe set by the governing documents. HOAs cannot unreasonably withhold approval for modifications that comply with community standards.
