Parties must serve a Request for Resolution; failure to respond within 30 days permits litigation. Civil Code 5960 allows courts to consider refusal to participate when awarding attorney fees. Small claims and assessment collections are exempt from ADR. The HOA must also have election dispute procedures under Civil Code 5145 with inspector of elections oversight.
