Customers, clients, and employees must park on-site (or off-site only where the site cannot accommodate on-site parking), and the home occupation may not cause resident occupants to park elsewhere (E.6). Employees, visitors, students, and clients are permitted only between 7 a.m. and 7 p.m. (E.7). Home occupations involving the display or sale of products from the site are prohibited except by mail, telephone, internet, or other electronic communication, unless permitted under the Cottage Food provision (E.8). Only one vehicle, owned by the operator and not exceeding one ton in capacity, may be used in conjunction with the home occupation (E.11); home occupations involving more than one commercial vehicle parked on-site are not permitted, and business equipment, machinery, attachments, or trailers may not be visible from the public right-of-way or neighboring properties (E.12). The use may not generate passenger or commercial traffic inconsistent with the normal level on the street, and there may be no deliveries or pick-ups from commercial vehicles except those used by mail carriers (E.10).
Exceeding the client/student caps, operating outside 7 a.m.-7 p.m., conducting prohibited on-site sales, or using more than the one permitted work vehicle violates FMC 15-2735. Under FMC 15-6305 it is a Development Code violation chargeable as a misdemeanor or infraction, with each day a separate offense, and is a public nuisance subject to abatement under FMC 15-6304 and 15-6307.
