Summary

California Health & Safety Code §1597.40 preempts Carlsbad from restricting family daycare homes. Small (up to 8 children) and large (up to 14 children) family daycares are allowed by right in all residential zones with state licensing.

(a) It is the intent of the Legislature that family daycare homes for children should be situated in normal residential surroundings so as to give children the home environment that is conducive to healthy and safe development. It is the public policy of this state to provide children in a family daycare home the same home environment as provided in a traditional home setting.

(b) The Legislature declares this policy to be of statewide concern with the purpose of occupying the field. This act, the state building code, and the fire code, and regulations promulgated pursuant to those provisions, shall preempt local laws, regulations, and rules governing the use and occupancy of family daycare homes. Local laws, regulations, or rules shall not directly or indirectly prohibit or restrict the use of a facility as a family daycare home, including, but not limited to, precluding the operation of a family daycare home.

Full Breakdown

California's Family Daycare Homes Act (Health & Safety Code §§1597.40-1597.465) preempts local zoning: cities must treat family daycare homes as a residential use of property. Carlsbad cannot require a conditional use permit, public hearing, or special zoning approval. Operators must hold a Community Care Licensing Division (CCLD) license, maintain liability insurance, and comply with fire and building safety rules. A Carlsbad business license (CMC Title 5) is required, and the operator must notify neighbors per state law. Small family daycares (up to 8 children) and large family daycares (up to 14 children, with an assistant) are both permitted by right.

Violations & Fines

Operating without a state license: misdemeanor, up to $200/day civil penalty under H&SC §1596.890. Business license noncompliance: standard Carlsbad administrative citation (~$100-$500).

Frequently Asked Questions

Can Carlsbad require me to get a conditional use permit to run a home daycare?
No. California Health & Safety Code §1597.45 preempts cities from requiring a CUP, public hearing, or special zoning approval for licensed family daycare homes. It must be treated as a residential use.
How many children can I care for in a Carlsbad home daycare?
Up to 8 children under a Small Family Daycare license, or up to 14 children under a Large Family Daycare license (with a qualified assistant). Both are permitted by right in any Carlsbad residential zone.
