Full Breakdown

040(A) permits home occupations in residential zones as an accessory use, but only if they are "not disruptive to the residential character of the neighborhood" and remain "clearly incidental and subordinate" to the dwelling's residential use; the business cannot change the principal character or use of the dwelling or property. The floor-area cap is explicit: a home occupation "may not utilize an area greater than 20% of the combined total floor area of all on-site structures," and it must be conducted entirely within the dwelling or an attached garage, with an exception carved out for sports tutoring.

No exterior evidence of the business is allowed, including outdoor display of equipment, materials or supplies. Employees are barred from working on the premises unless required by local or state law, and no separate entrance or exit may be built for the business unless local or state law requires one. Indoor storage of goods or supplies is capped at 125 cubic feet within no more than one room of the dwelling and/or the attached garage, and the home's required residential off-street parking must still be maintained.

Equipment that causes visible or audible interference with radio or television reception, or voltage fluctuations outside the unit, is prohibited, as is dust, glare, noxious matter, excessive noise or vibration crossing the property line. 040(G), and must comply with all applicable noise, lighting, nuisance and health/safety regulations under subsection (H).

Violations & Fines

Operating a home occupation without the required city business license, exceeding the 20% floor-area limit, or generating exterior evidence of the business (outdoor equipment, storage, or nuisances such as noise, dust or radio interference) puts the operator out of compliance with Section 21.10.040 and subjects the use to the city's standard code enforcement and business license revocation process.

Frequently Asked Questions

How much of my Carlsbad house can I use for a home business?
No more than 20% of the combined total floor area of all structures on the property, per Municipal Code Section 21.10.040(A)(2). The business must also stay clearly incidental to the home's residential use and cannot change the dwelling's principal character.
Do I need a permit to run a home occupation in Carlsbad?
You need an approved city business license before starting, under Section 21.10.040(G); the code does not describe a separate discretionary zoning permit for a compliant home occupation, but it must meet every condition listed in Section 21.10.040(A).
Can I hire employees to work at my Carlsbad home business?
No. Section 21.10.040(A)(4) prohibits employees on the premises unless local or state law requires them, and the operation must otherwise remain a use conducted by the residents themselves.
