EMC Article 44 regulates home occupations. A business license is required for any business operated in a dwelling unit or accessory building. Minor home occupations have little to no external indication of commercial activity. Major home occupations may have external indicators but remain home occupations; only household members and up to two non-resident employees who commute to the site may be employed at any time. The Director may authorize issuance upon application, stating the permitted occupation, conditions, and time limitations. Cottage food operations and microenterprise home kitchen operations (MEHKO) under the California Homemade Food Act require a business license. Swimming pools in accordance with code provisions and minor home occupations are permitted (P) as accessory uses in all residential zones (R-A through R-5).
