EMMC 17.65.090 folds day cares and preschools into the general home business licensing scheme rather than creating a separate track: the license official, or a designee, may approve a home business license for a day care or preschool once it satisfies the approval criteria of Chapter 17.65 EMMC, and the code states these uses will be treated as any other home business. That means a home day care must meet the floor-area cap of one-third of the dwelling under EMMC 17.65.060(A), though the code specifically allows an exception to that cap for day cares and preschools; the one-employee limit in EMMC 17.65.060(B); the outdoor-activity restriction in EMMC 17.65.060(E), which does allow approved outdoor play time for preschools and day cares; and the 7:00 a.m. to 9:00 p.m. client hours in EMMC 17.65.060(F).

EMMC 17.65.090 adds two day-care-specific conditions on top of those general standards. First, an applicant for an in-home day care must provide evidence of any mandatory state license as part of the application. Second, any day care or preschool proposed within a unit lacking typical ground-level access, such as an upper floor of a condominium, must meet all ingress and egress standards the International Fire Code requires. EMMC 17.65.060(M) separately requires fire inspections for day care providers before the space can be used.
