Orem, UT Home Business: Home Daycare (2026)

Orem City Code Section 22-6-9(F) permits four categories of in-home day care in every residential zone: Home Adult Day Care, and Home Child Day Care in Small, Medium and Large tiers, as defined in Section 22-2-1. All four are subject to the same operating conditions. Every provider must be properly licensed by the Utah Department of Human Services where required, and every category except Home Child Day Care, Small must also hold a City of Orem business license under Chapter 12 before opening. Home Adult Day Care is capped at six functionally impaired adults, including the provider's own dependent adults, and must be run out of the caregiver's own residence.

The use must stay clearly incidental and secondary to the home's residential character: no street-visible or neighbor-visible signage of any kind is allowed, and a day care may not operate at all in a dwelling that already has an accessory apartment. Any outdoor play area for a Home Child Day Care must be fully enclosed by a 6-foot fence with self-closing, self-latching gates and must include a soft-surface outdoor play area kept out of front yards and any side yard facing a dedicated street. Outdoor play is barred between 9:00 p.m. and 8:00 a.m. A provider may employ only one nonresident worker, who must have a dedicated off-street parking space, and total traffic generated between 9:00 p.m. and 6:00 a.m. cannot exceed two car trips per hour if the operation runs 24 hours. A provider caring for children overnight is limited to two unrelated children or one family on a 24-hour basis, and Home Day Care, Large must comply with Orem's building and fire codes, including required inspections.
