Section 21-11-5 licenses in-home child day care and other group child activities, dance schools, preschools, music classes, as a home occupation. As a Category I permitted use, the operation is capped at eight children associated with day care or group activities at any one time, and a maximum of eight students or children per day, a count that includes the licensee's own children if they're under six and in the licensee's care during business hours. Every Category I facility must also provide safe outdoor play time and space as required by federal, state, county or local law.

A provider who needs to serve more children can't simply exceed the cap; they must instead apply for a Category II conditional use permit reviewed by the Planning Commission, which can authorize up to 16 children at any one time and 18 per day, along with a hard ceiling of 24 vehicular drop-off or pick-up stops daily. Group child activities besides day care, such as dance or music classes, get their own Category II track capping enrollment at 12 students per session and 24 per day across up to four sessions, and no such Category II activity can be sited within 300 feet, property line to property line, of another Category II group child activity use.
