Maricopa City Code 18.120.120 allows home occupations as an accessory use in residential dwellings with a zoning permit. The business may occupy no more than one-quarter of the total floor area of the principal and accessory buildings, must be clearly incidental to the residential use, and cannot change the residential character of the property.
The City of Maricopa permits home-based businesses as home occupations under Maricopa City Code 18.120.120, an accessory use that must remain clearly secondary to the residential use of the dwelling. A home occupation requires a zoning permit. A central zoning limit is floor area: a home occupation shall not occupy more than one-quarter of the total floor area in the principal building and any accessory building on the lot. The code lists permitted home-occupation uses such as professional offices; offices for personal services (janitorial, garden, or office services); dressmaking, tailoring, millinery, and other home sewing work; handicrafts such as weaving and leatherwork; instructional classes not exceeding five students at a time; mail order or direct sales (provided no direct sales to customers occur from the residence); minor food handling, processing, or packing; and trades such as plumbers, electricians, contractors, pool-service providers, locksmiths, and minor electronics and watch repair. Certain uses are expressly prohibited, including the repair, reconditioning, servicing, or manufacture of any internal-combustion or diesel engine or any motor vehicle (automobiles, trucks, motorcycles, boats), and kennels or the storage, care, or grooming of animals. The home occupation must not generate more than five additional daily trips related to the business, averaged over a work-week, and on-site display or walk-in retail sales are not permitted. These standards apply to residential zoning districts in the City of Maricopa, Pinal County.
Operating a home business without the required zoning permit, exceeding the one-quarter floor-area cap, running a prohibited use such as auto repair or a kennel, or generating walk-in retail traffic can result in code-enforcement action, fines, and an order to cease the use.
