Full Breakdown
Town Code Chapter 168 sets Huntington's floodplain construction standards outside the incorporated villages of Huntington Bay, Lloyd Harbor, Northport and Asharoken, which run their own codes. Under § 168-20(A), any new construction or substantial improvement in Zones A1-A30, AE or AH, or in Zone A where base flood elevation data exist, must have the lowest floor, including a basement or cellar, elevated to or above two feet above the base flood elevation shown on the Town's Flood Insurance Rate Map. Where Zone A carries no published base flood elevation, § 168-20(B) instead requires the lowest floor elevated at least three feet above the highest adjacent grade.
Zone AO parcels use a depth-number-plus-two-feet formula under § 168-20(C), and § 168-20(D) requires drainage paths around structures on sloped AH and AO sites. Coastal high hazard Zones V1-V30, VE and V follow a separate pile-and-column elevation standard in § 168-21 rather than fill. These standards apply on top of the general anchoring, flood-resistant materials and utility-elevation rules in § 168-18 and § 168-19, and the elevation work is folded into the floodplain development building permit issued under § 168-13, which rides along with the Chapter 87 building permit at no extra fee (though the Local Administrator, the Director of Engineering Services, may require up to a $1,500 deposit for extraordinary review costs). Non-compliant construction is reported to FEMA if no variance was granted.
Violations & Fines
Under § 168-40(A), as amended by L.L. No. 56-2019, building below the required elevation is a violation punishable by a fine of not less than $1,000 nor more than $5,000, up to 15 days imprisonment, or both, with each day the violation continues counted as a separate offense. The Local Administrator may also issue a stop-work order under § 168-39, and disregarding it is a separate misdemeanor with escalating fines up to $15,000 for repeat offenses.
