Tree removal permit rules in Laguna Niguel, CA — sometimes called heritage tree, protected tree, or street tree ordinances — list which trees require a permit before you can cut them down.
Laguna Niguel has no private-property tree-removal permit. Its 2024 tree ordinance only makes it unlawful to remove or damage a tree on public property without the Public Works Director's written permission. Private and HOA trees fall outside City code.
Laguna Niguel Municipal Code Sec. 11-8-64(a), adopted by Ordinance No. 2024-230 (effective 2024), makes it unlawful to damage or remove a tree on public property without written permission from the Public Works Director. Sec. 11-8-62 lets the Director remove public trees that are dead, diseased, or that threaten utility, water, or sewer lines. There is no heritage-tree or view-tree ordinance for private residential lots, typical of Orange County master-planned cities that protect street, parkway, and park trees rather than private canopy. Private trees are commonly governed by HOA CC&Rs, and slope vegetation by OCFA fuel-modification plans. Owners removing a private tree should still confirm no active bird nests, as California Fish and Game Code Sec. 3503 protects nests statewide.
Removing or damaging a public, parkway, or park tree without the Director's written permission violates LNMC Sec. 11-8-64 and can expose the offender to restitution for the tree's appraised value. No City permit or fine applies to private removals.
