Glen Cove Chapter 263 (Trees) requires city authorization before trimming, pruning or removing any tree in the public right-of-way. The Tree Commission and Building Department Administrator share authority over street trees and tree-removal permitting.
Property owners are generally responsible for trimming branches of their own trees that overhang neighboring properties, and may trim back overhanging branches from neighbor trees up to the property line without permission, consistent with NY common-law nuisance/abatement doctrine. Trees located in the public right-of-way (typically the strip between the curb and the sidewalk) belong to the city and may only be trimmed by the DPW or its contractor. The Tree Commission also reviews subdivision and site-plan applications for tree-preservation conditions.
Unauthorized trimming or topping of street trees triggers replacement obligations and Chapter 263 fines enforceable under Β§ 1-15 (up to $1,000 / 15 days). Heritage tree-removal violations are substantially more expensive (see tree-removal-permits).
