Essex County does not regulate residential weeds or brush. In New Jersey, weeds and overgrown vegetation are municipal nuisances enforced by each town under N.J.S.A. 40:48-2, which lets municipalities order abatement and lien unpaid cleanup costs.
There is no countywide Essex County weed ordinance for private property. New Jersey authorizes municipalities under N.J.S.A. 40:48-2, including subsection 40:48-2.13, to declare tall grass, weeds, brush, and debris a nuisance and to order owners to remove them. Each Essex County municipality, including Newark, adopts and enforces its own property-maintenance and weed provisions through its code or property-maintenance official, with its own definitions, notice periods, and penalties. The county's role is limited to maintaining county-owned parcels, county park land, and county road rights of way. If you have a weed or overgrowth complaint, or want to know the standard for your parcel, contact your municipal code enforcement, zoning, or health office rather than the county.
Under the municipal ordinance, the town serves written notice to abate weeds and brush within a stated time. If the owner fails to comply, the municipality may remove the growth and charge the cost to the owner, entering unpaid amounts
