Locally, Section 11-1-3 (Nuisance - Definition), item 10, makes 'Noxious weeds located on vacant lots or other property, along public sidewalks or the outer edge of any public street, or weeds in any other location which constitute a fire hazard' a public nuisance, abated 'by discing, plowing, or mowing weeds within 4 inches of the ground and by removing the cut weeds.' Item 16 adds overgrown or uncultivated vegetation that is hazardous, obstructs traffic, or harbors pests. Statewide, the Utah Noxious Weed Act (Utah Code Title 4, Chapter 17) directs landowners to control state- and county-designated noxious weeds and authorizes county weed boards and the Utah Department of Agriculture and Food to compel control; the state designated-weed list is maintained under Utah Admin. Code R68-9. Because the City's nuisance authority and the state Act overlap, an Orem property owner with designated noxious weeds can be required to abate them under both the local nuisance process and state weed-control authority.
Under the local code, failing to abate a weed nuisance lets the City abate the property and recover costs, and maintaining the nuisance is a class C misdemeanor (Section 11-1-8). Under the Utah Noxious Weed Act, county weed-control authorities may order control of designated noxious weeds and carry out control at the owner's expense if the owner does not comply.
