Polk County's Property Maintenance Ordinance (08-047) prohibits weeds over 18 inches on lots two acres or less next to residential or commercial parcels. Code Enforcement handles complaints; failure to cut leads to county abatement and a lien for costs.
Under Polk County Ordinance 08-047, as amended, overgrown lots are prohibited in unincorporated areas. Grass or weeds on a lot two acres or less adjoining a parcel with a residential or commercial building may not exceed 18 inches for more than 10% of the property. On larger lots the limit applies within 200 feet of such an adjacent property line. A code officer investigates, mails notice, and posts the property; the owner then has 10 days to abate. Agricultural lots are treated separately. Weeds in wetlands or conservation areas are not counted the same way.
Ten days after posting, Polk County abates the violation and assesses all vendor, administrative and operating costs against the property, recorded as a first lien equal to a property-tax lien.
