Brookhaven, GA Mobility & Curb Rules: Bike Lane Rules (2026)

Sec. 17-430 has three subsections. Subsection (a) says no motor vehicle or motorcycle shall be operated on any bicycle lane or path for any purpose, and it names parking, passing and turning as covered purposes unless another provision of Chapter 17 permits the movement. Subsection (b) is broader: no person shall at any time drive, stop or park any vehicle except an emergency vehicle within a bike lane or bike path. Subsection (c) covers crossings: a driver who drives upon or across a bicycle lane must first give the right-of-way to all bicycles within the lane.

The rules for the riders themselves sit in the bicycle article of the same chapter. Sec. 17-318(c) says no person shall ride a bicycle on a roadway with designated bicycle lanes except within the lane or as the chapter otherwise permits, and it bars riding on a roadway next to a bicycle path that is less than 75 feet from the roadway and in safe condition for bicycle riding. Under Sec. 17-318(a), a cyclist entering a bicycle lane or path yields to bicycles approaching upon it. Under Sec. 17-318(b), the driver of a vehicle overtaking a bicycle passes to the left at a safe distance. Sec. 17-319(b) requires motor vehicles completing a right turn to yield to bicycles crossing the intersecting roadway or completing a right turn.

Sec. 17-321 makes it unlawful to ride a bicycle on a sidewalk, with an exception for children 12 years of age or younger who yield to pedestrians. Sec. 17-318(d) lets the city restrict bicycles from a roadway it determines to be unsafe by erecting a sign that directs riders to a suitable alternative route. The Brookhaven Police Department enforces the traffic chapter.
