Fauquier County, VA Mobility & Curb Rules: Red-Light Cameras (2026)

Section 13-24.3 authorizes the Sheriff's Office, directly or through a private vendor, to install and operate photo speed monitoring devices in school crossing zones to enforce Code of Virginia Sec. 46.2-873. Enforcement runs from 30 minutes before to 30 minutes after normal school operating hours, plus any additional hours schools run care, athletics, summer school or other activities. A sign must be posted within 1,000 feet of any camera, and there is a rebuttable presumption the sign was in place at the time of the violation.

For the first 30 days after a camera goes live in a school crossing zone, registered owners caught speeding get only a written warning, not a civil penalty. After that, the registered owner is liable for a $100 civil penalty, rebuttable if the owner submits an affidavit or testifies that someone else was driving, naming that person, or shows the vehicle was reported stolen before the violation. A companion section, Sec. 13-24.4, extends the same photo speed monitoring authority to highway work zones and high-risk intersection segments, with a $100 civil penalty triggered only when a vehicle is clocked at least 10 mph over the posted limit while the zone is active; penalties from high-risk intersection segments are forwarded to the state's Highway Safety Improvement Program rather than kept locally.
