750(B)(16) of the Florissant Code of Ordinances prohibits operating any noise-creating blower and power fan, or any internal combustion engine whose operation causes noise from the explosion of operating gases or fluids, unless the noise from that blower or fan is muffled and the engine is equipped with a muffler device sufficient to deaden the noise. Air-handling, cooling and ventilation blowers, the mechanical category most HVAC condenser and exhaust fans fall into, sit squarely within the plain language of noise-creating blower and power fan, so a commercial or residential unit that runs without adequate sound dampening can be cited under this provision.

As with the rest of the noise Article, this is one of eighteen specific activities listed under Subsection B following Subsection A's general prohibition on loud, unnecessary or unusual noise that disturbs the neighborhood's peace, comfort or repose; the twelve factors in Subsection A, including the noise's proximity to a residential sleeping facility, its duration and whether it is constant or intermittent, come into play when the equipment is not obviously unmuffled but still draws a complaint. The Section fixes no decibel ceiling or specific setback distance for HVAC equipment; the muffling standard and the general disturbance factors are what officers apply.

Florissant Police investigate complaints, and violations are prosecuted in Florissant Municipal Court under the City's general Chapter 210 penalty because the noise Article itself sets no fine.
