Vestavia Hills, AL Noise Ordinances: Amplified Music & Outdoor Sound (2026)

Section 11-66(2)(a) of the city's Noise Control Ordinance (Ord. No. 2310, adopted November 23, 2009) makes it a nuisance and unlawful to operate or play any radio, television, phonograph, musical instrument or similar device that produces or reproduces sound from a business, residence or other premises if the sound is plainly audible at a distance of 30 feet to any person in a commercial, residential, multi-family dwelling, professional office building, institutional or public place. m. 'Noise disturbance' is defined at § 11-64 as any sound that endangers or injures the safety or health of humans or animals, annoys or disturbs a person of normal sensitivities, or endangers property.

Enforcement runs under § 11-62 through the city's general police power, Code of Ala. 1975 § 11-45-1 et seq. Section 11-67 exempts permitted band or orchestra performances, church bells and chimes, emergency-vehicle equipment, licensed radio station remote broadcasts during daylight hours, school programs, and mayor-authorized public events and parades. The mayor or a designee can also grant a special variance under § 11-70 for a specific activity, subject to written conditions and a time limit.
