Antioch Municipal Code sections 5-17.04 and 5-17.05 limit construction activity and heavy construction equipment to 7 AM-6 PM weekdays (8 AM-5 PM if within 300 feet of an occupied dwelling) and 9 AM-5 PM on weekends and holidays. Violations can trigger Stop Work Orders.
Antioch's construction noise rules are codified in two parallel sections of Chapter 17. Section 5-17.04 covers HEAVY CONSTRUCTION EQUIPMENT, defined as 'equipment used in grading and earth moving, including diesel engine equipped machines used for that purpose, except pickup trucks of one ton or less' (the term OPERATE includes 'starting, warming-up, and idling'). Section 5-17.05 covers CONSTRUCTION ACTIVITY generally, defined as 'the process or manner of constructing, building, refurbishing, remodeling or demolishing a structure, delivering supplies thereto and includes, but is not limited to, hammering, sawing, drilling, and other construction activities when the noise or sound therefrom can be heard beyond the perimeter of the parcel where such work is being performed.' Floor covering installation and painting using non-powered equipment are excluded. Both sections impose identical hour restrictions: (1) on weekdays, no work prior to 7:00 a.m. or after 6:00 p.m.; (2) on weekdays within 300 feet of occupied dwelling space, no work prior to 8:00 a.m. or after 5:00 p.m.; (3) on weekends and holidays, no work prior to 9:00 a.m. or after 5:00 p.m. irrespective of distance from the occupied dwelling. Section 5-17.05(C) authorizes city employees to issue Stop Work Orders for violations of either section, and those orders 'shall not be released until the holder of the building permit provides assurance that future violations will not occur.' Section 5-17.06 (Ord. 2032-C-S, 2009) delegates to the City Manager or designee authority to grant project-specific waivers.
