Carmel City Code Sec. 6-158(b)(15) exempts building-construction sound only between 7:00 a.m. and 9:00 p.m. Monday-Friday, and 8:00 a.m. to 9:00 p.m. on Saturday, Sunday, and Indiana state holidays. Outside those hours, construction noise is allowed only for a bona fide emergency.
Construction noise is governed by the exemption in Sec. 6-158(b)(15), which permits 'sounds associated with building construction' only within set hours; outside them the general decibel limits and audibility test of Sec. 6-158(a) apply. Following a 2022 amendment by the Carmel City Council, the permitted window is 7:00 a.m. to 9:00 p.m. Monday through Friday and 8:00 a.m. to 9:00 p.m. on Saturday, Sunday, and holidays recognized by the State of Indiana. The Council moved the weekend/holiday start time from 7:00 a.m. to 8:00 a.m. after numerous early-morning construction-noise complaints; the 9:00 p.m. end time was left unchanged. Construction at other times is allowed only when necessitated by a bona fide 'emergency' as defined in Indiana Code 36-1-2-4.5. The city has also clarified that music is not considered valid construction noise. Separately, Sec. 6-158(b)(2) lets construction and repair equipment and power tools operate (when properly muffled) only between 6:00 a.m. and 10:00 p.m.
A construction-noise violation is an infraction under Sec. 6-158(d), with fines escalating from up to $250 (first offense) to up to $2,500 (fourth and subsequent offenses). Sworn Carmel Metropolitan Police officers issue citations (Sec. 6-158(f)), enforced through the Carmel City Court (Sec. 6-158(e)).
