Section V-213-3.06 lists exemptions from the off-site construction rules: (1) emergency construction or repair necessary to protect life and property; (2) work preempted from local regulation by state law, such as construction of public school buildings; (3) furnishing utility-type service, including construction and maintenance of utility facilities; (4) any work on an existing single-family or duplex dwelling undertaken by the property owner; (5) work in the public right-of-way deemed necessary by the Public Works Director; and (6) any other circumstance where the City Manager deems an exemption appropriate.
Construction outside the 7 a.m.-7 p.m. window, or on a listed holiday, is a Chapter 213 violation - a public nuisance under V-213-4 that may be charged as an infraction under V-213-5. The city can also pursue abatement through the City Attorney (V-213-6), and the Building Division can pair noise enforcement with permit conditions and stop-work authority on active projects.
