Milpitas, CA Noise Ordinances: Construction Hours (2026)

Construction noise in Milpitas is governed by the Site Construction Regulations of Chapter 213. Section V-213-3.05 provides that no person shall engage in (or permit) construction of any building, road, walkway, pool, or landscape improvement - including delivery of construction materials - except within the hours of 7:00 a.m. to 7:00 p.m. on weekdays and weekends. No construction work may be performed on the holidays listed in the chapter. Per V-213-2.07, those holidays are New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day. The same 7 a.m.-7 p.m. window therefore applies all seven days of the week, with the six holidays carved out completely. Section V-213-3.06 lists exemptions from the off-site construction rules: (1) emergency construction or repair necessary to protect life and property; (2) work preempted from local regulation by state law, such as construction of public school buildings; (3) furnishing utility-type service, including construction and maintenance of utility facilities; (4) any work on an existing single-family or duplex dwelling undertaken by the property owner; (5) work in the public right-of-way deemed necessary by the Public Works Director; and (6) any other circumstance where the City Manager deems an exemption appropriate.
